D3 snorkel trap

I have a Land Rover original equipment snorkel on my 2007 D3. Recently I discovered that the tube that runs through the inner guard and connects the original air intake to the air cleaner is porous. Also the elbow where this tube joins the air cleaner has holes drilled in it. It makes no sense to me to have a raised snorkel to prevent water entering the engine if the original connecting tube is not watertight. Does anyone know why Land Rover has this design and if replacing them with watertight fittings will cause a problem?
