Help me identify this part in the wheel well?

My LR3 was towed the other night and from what I can tell, they didn't do it right. On both sides of the vehicle there is a piece bent into the wheel well that causes rubbing/grinding on the tires if I turn the wheel. Can anybody tell me what this part is that I'm looking at? See attached photos.

Did they bend the side protection crash bar forward?

That seems like a reasonable answer, but I can't seem to find a good parts diagram to confirm. If that is the case, anybody know what all will need to happen in order to fix it?

Looks like it to me also, those should be flat, they look like they bolt on so you could take them off and have them pounded back into shape.

The part is only $40 on rover parts west. In the body the body hardware - frame section.

I hope they used a flat bed... how did they do that damage? are they liable?
