Jerry I would have your service guy call the Thousand Oaks CA Service Center and ask the techs what exactly they did. I believe it was something as simple as them exiting the reflash program properly. If you dont exit the reflash program properly the flash wont take. The Thousand Oaks service center phone number is 805-267-3600. Any of the guys in service can help you.

Thanks. I'll probably call them myself so I understand what to tell them to look for. They won't spend the money at the dealer.

Great post Mr. Hunt..
Like you, Ive been doing my research on a 2005 HSE..Everything seemed ok during my first test drive. Im getting an independent mechanic to go inspect the car on Friday at the dealership and armed with the advice that I have received from this forum, Im going to go for another drive on Saturday..and by Saturday afternoon... I may or may not have myself a LR3..
A bit of me is scared based on some of the problems that I have been reading about. But with posts like yours.. it shows me that there may be a light at the end of the tunnel. Will keep you posted.
